Virginia State Sen. Louise Lucas Indicted on Federal Racketeering, Marijuana Distribution Charges

Virginia Sen. Louise Lucas and six co-defendants face federal racketeering, marijuana distribution and money laundering charges. She vows to fight them.

October 22, 2026, NORFOLK, Va. — Virginia State Sen. Louise Lucas, a Democrat from Portsmouth and one of the most powerful figures in Richmond, has been indicted by a federal grand jury on charges including racketeering conspiracy, marijuana distribution conspiracy and money laundering, the Justice Department announced Thursday. Lucas, 82, surrendered to authorities and has vowed to fight the charges.

Attorney General Todd Blanche and FBI Director Kash Patel announced the case at a joint press conference. Prosecutors allege Lucas led a criminal enterprise, which they call the “Lucas Enterprise,” that used her legislative influence to protect and enrich a cannabis business she co-owns. Lucas faces five of the eight counts in the indictment, which was filed in the Eastern District of Virginia.

A Three-Decade Lawmaker

Lucas, who serves as president pro tempore of the Virginia Senate, has been in the chamber for more than three decades. Blanche noted that she has held a position of public trust in Virginia for that entire time. Patel said the indictment alleges she abused that position to put her own financial interests ahead of her constituents, in a scheme prosecutors estimate was worth $4.5 million.

The Alleged “Lucas Enterprise”

According to the Justice Department, the alleged operation ran from around 2019 through 2026. Prosecutors say Lucas and her daughter Lisa Lucas-Burke opened The Cannabis Outlet in Portsmouth in 2021. Her other daughter, Theresa Lucas-Lamb, and grandson, Ryan Eichelberger, allegedly acquired marijuana, supervised its distribution and managed the store.

Six others are charged alongside Lucas:

  • Lisa Lucas-Burke (daughter)
  • Theresa Lucas-Lamb (daughter)
  • Ryan Eichelberger (grandson)
  • Carlton Upton Jr. (former business partner)
  • Prince Albert William Hudson III
  • Tameka Johnson

Prosecutors allege Lucas also used her political influence to shape cannabis legislation and regulations for the group’s benefit and to insulate the operation from state law enforcement.

Lucas Pushes Back

Lucas posted a statement on X vowing not to back down. After FBI agents searched her Portsmouth office and an adjacent cannabis business in May, she called the federal action political intimidation. Her attorney has argued the case is politically motivated. Blanche rejected that, saying the Justice Department does not “do political paybacks,” and noted the investigation began before the current administration.

Senate Democratic Leader Scott Surovell said in a statement that the indictment contains serious allegations but that Lucas is entitled to the presumption of innocence. An indictment is an accusation, not a finding of guilt.

What Comes Next

Lucas, an outspoken critic of President Donald Trump who helped lead Virginia’s push to redraw its congressional map, is not up for reelection this year. Her removal from or continued role in Senate leadership could become a question for Democrats ahead of the next legislative session.
